Lawsuit Against City Clerk Marie Wicks Dismissed

This frivolous lawsuit was dismissed this morning by Judge Clinton Canady. I’m pleased, but not at all surprised by the court’s prompt decision.
The East Lansing City Clerk performed the duty assigned to her by state law with professionalism and integrity. She conducted a fair and impartial canvass of the charter amendment petition. That canvass rightly concluded that Mr. Hank failed to submit the requisite number of signatures to have his proposal placed on the November ballot.
Amending the City Charter is the local equivalent of amending the constitution. It should not be taken lightly. The rules established by the state and followed by the City Clerk exist to protect the integrity of the initiative process.
Frankly, Mr. Hank’s proposed charter amendment is bad public policy. It's bad for the citizens and taxpayers of East Lansing. But that’s not why it won’t be on the ballot in November. It won’t be on the ballot in November because Mr. Hank failed to submit the required signatures and comply with the long-standing requirements of state law governing initiatory petitions.
